1. Conditions for Plot Development
Purchasers have the liberty to construct one housing unit on their plot, subject to the terms of the Agreement for Sale and the Architectural Policy and Regulations (Architectural Policies) provided by the Vendor. Additionally, a Deed of Covenant will be executed simultaneously with the Agreement for Sale, outlining the regulations all plot owners must adhere to. This deed aims to maintain a high-quality lifestyle, living environment, and welfare for all residents and homeowners within the estate.
2. Using Own Contractors and Professionals
Purchasers may select from the Vendor-approved contractors for the construction of their homes. While the terms of engagement with these contractors will be private, they must still comply with the Agreement for Sale and the Architectural Policies. It is mandatory for Purchasers to retain the estate Architect and Structural Engineer, while it is strongly encouraged to use other project professionals. Construction will only be deemed complete upon issuance of a Certificate of Practical Completion by the Vendor’s Architect.
3. Timeframe to Build
Purchasers are required to commence construction of their residential unit within 12 months from the date of receiving the Title in their name from the Vendor’s Advocates. The construction must be completed within 18 months from the title receipt date, unless an extension is granted by the Vendor.
4. Construction Period and Enforcement Measures
A security deposit of 12% of the Purchase Price is required from the Purchaser, held as one-year security for the timely completion of construction. The Vendor reserves the right to debit this escrow account monthly by Ksh 100,000 for any delays in construction. If the security deposit is depleted due to delays in commencement or completion, the Vendor may impose a fine of 3% per month (compounded monthly) on the Purchase Price. In extreme cases, the Vendor may deny the Purchaser access to the property until construction is completed.
5. Plot Servicing by the Vendor
The Vendor is responsible for providing the necessary infrastructure for the development. This responsibility is considered fully discharged when:
- Reasonable access to the property is provided for the Purchaser to begin construction.
- All prescribed utility services are connected or made accessible to the property.
- A boundary wall and secure gate are completed to control access to the estate.
